South Carolina Reprimands Attorney For Failing to Serve Subpoenas On Opposing Party

IN THE MATTER OF FABRI, SC: Supreme Court 2016 – Google Scholar:

‘via Blog this’

The Supreme Court of South Carolina has issued a public reprimand to an attorney who issued two subpoenas to third parties requiring them to bring documents to a court hearing, but who failed to serve the opposing party. There is no question that the conduct violated the rules, but I have never seen a disciplinary case for such conduct. The Court appeared to believe that the violations were deliberate and were not accidental because the attorney appeared to use the subpoenas to gain financial information about an opposing party in a family law case.
